Terms of Service

1. Introduction

Welcome to ASAP 多元活動平台 (“ASAP”, “we”, “us”, or “our”), an online platform that connects interest-activity organisers with participants in Hong Kong. By accessing or using our website and services you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the platform.

These Terms are governed by the laws of the Hong Kong Special Administrative Region (“Hong Kong SAR”). Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

2. How the Platform Works

ASAP operates on a crowd-gating model. Understanding this model is essential before making any reservation:

  • Free reservation: Signing up for an activity session is free and places a non-binding hold on a spot for you. No payment is taken at this stage.
  • Minimum headcount: Each session has a minimum number of participants required for the activity to run. This threshold and the signup deadline are shown on the activity listing.
  • Confirmation: A session is confirmed automatically once the minimum headcount is reached, or when explicitly confirmed by the organiser. Confirmed participants will be notified and the deposit becomes due.
  • Cancellation for low interest: If the minimum headcount is not reached by the signup deadline the session is cancelled. No deposit is charged in this scenario.

3. Deposit Policy

  • The deposit amount (in Hong Kong Dollars, HKD) is displayed on each activity listing before you reserve.
  • Deposits are only due after a session is CONFIRMED. Upon confirmation, the organiser will provide payment instructions (e.g. PayMe QR code, bank transfer, or other method).
  • You must complete payment within 3 days of receiving the confirmation notice. Failure to pay within this window may result in your booking being released and your spot offered to waitlisted participants.
  • Deposits are per-session and non-transferable. A deposit paid for one session cannot be applied to a different session.
  • Deposits do not constitute the full activity fee. Total pricing (if any additional fees apply) will be communicated by the organiser before or during the activity.

4. Refund Policy

Refund eligibility depends on when a cancellation occurs and who initiates it.

The no-refund policy for confirmed bookings exists because late cancellations may cause headcount to fall below the minimum, harming all other confirmed participants and the organiser. We enforce this consistently and without exception unless ASAP, at its sole discretion, determines extraordinary circumstances apply.

Intermediary role: ASAP provides the booking platform but is not itself the activity provider. Deposit disputes are primarily between the participant and the organiser. ASAP may mediate where reasonable but is not a party to the deposit transaction and accepts no financial liability beyond what is expressly stated in these Terms.

5. User Conduct

By using ASAP you agree not to:

  • Make fraudulent, speculative, or bad-faith reservations with no intention of attending.
  • Abuse the free-reservation system to block spots and prevent a session from filling.
  • Provide false personal information during registration or booking.
  • Harass, defame, or threaten organisers, instructors, or other participants.
  • Attempt to circumvent platform security or access accounts that are not yours.

ASAP reserves the right to suspend or permanently ban any account found in breach of these rules, without refund of any outstanding deposits.

6. Intellectual Property

The ASAP brand, logo, platform design, and original written content are the property of ASAP and may not be reproduced without prior written consent.

Activity organisers and instructors retain ownership of the photos, descriptions, and materials they submit to the platform. By submitting content, you grant ASAP a non-exclusive, royalty-free licence to display that content on the platform for the purpose of promoting the relevant activity.

7. Limitation of Liability

ASAP is a booking platform and intermediary, not an activity provider. We do not organise, supervise, or take responsibility for the activities themselves.

  • Physical activities (hiking, tennis, dance, etc.) carry inherent risks. Participants acknowledge and voluntarily assume all risks associated with participation.
  • Organisers are solely responsible for the safety standards, qualifications, and conduct of their activities.
  • ASAP's total liability to any user in connection with these Terms shall not exceed the deposit amount paid by that user in the relevant transaction.
  • ASAP is not liable for indirect, consequential, or special damages including loss of enjoyment or opportunity.

8. Changes to These Terms

ASAP may update these Terms at any time. The “Last updated” date at the top of this page will reflect the most recent revision. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms. For material changes we will display a notice on the platform.

9. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
